1. Contract formation
For contract conclusion, Sections 10 and 11 of the General Terms and Conditions for the use of the German-language eBay websites apply.

2. Contracting party
The contract is concluded between you and Raik Dominus, Sielower Waldstr. 5, 03055 Cottbus (hereinafter referred to as the seller).

3. Buyer requirements
If certain characteristics of the buyer are required, the existence of these characteristics is a prerequisite for a valid purchase contract. Bidders with the rating status “private” (hidden ratings) must obtain my explicit approval before placing a bid; otherwise, I reserve the right not to accept the bid.

4. Contract language

5. Jurisdiction
In business transactions with entrepreneurs and legal entities under public law, the place of jurisdiction for all disputes arising from the purchase contract is Cottbus.

6. Data protection
After conclusion of the contract, your personal data (in particular name, address, and email address) will be transmitted to us and stored for contract processing, customer service, and submission to authorities. By purchasing, you expressly agree to this storage.

Your personal data is protected in accordance with legal regulations. It will only be passed on to third parties if necessary for contract processing, e.g., to the shipping company commissioned by us.

You have the right to revoke your consent at any time with effect for the future.

7. Warranty and liability (used goods)
For all used items offered by me (including items described as “unused,” as they have already been placed on the market and are usually several years old), a warranty period of 1 year applies for consumers.

For businesses, warranty and further claims are excluded (e.g., testing, repairs, time expenditure, loss of profit or production loss), unless claims are based on intentional or grossly negligent conduct by the seller.

No warranty is provided for defects caused by improper use, failure to follow instructions, incorrect handling, improper storage, incorrect voltage/current, unsuitable cooling, or connection to unsuitable power sources.

Liability limitation
The seller is only liable for damages other than injury to life, body, or health if caused by intentional or gross negligence or breach of essential contractual obligations. Essential obligations are those necessary for proper contract execution and on which the buyer may regularly rely.

Further liability is excluded. Claims under product liability law or guarantees remain unaffected.

8. Scope of delivery
Only items shown in the photos are included unless otherwise stated. Background objects are not part of the offer.

If multiple identical items are offered, the buyer is only entitled to one item of similar type and condition.

Descriptions are made to the best of knowledge. If items are returned due to missing guaranteed properties, only the purchase price plus reasonable return shipping costs (max. original shipping cost) will be refunded; further claims are excluded.

9. International shipping
For deliveries outside Europe, items are generally shipped without batteries. No price reduction is granted for this. Batteries may be returned for disposal free of charge if included.

10. Address and delivery
Invoice and shipping address are those registered with eBay. Changes require explicit confirmation.

Additional costs due to incorrect addresses are borne by the buyer.

For pallet/special shipping, the buyer must ensure acceptance within 5 working days (8 a.m. to 5 p.m.). A phone number is required. Additional costs due to failed delivery attempts are borne by the buyer.

11. Shipping costs
Shipping costs apply only to mainland Germany including Rügen. PO boxes and parcel stations only by agreement.

If no shipping is offered, goods must be collected unpacked.

12. Billing address
A different billing address must be provided in advance.

13. Payment
Delivery is generally against advance payment. Payment is due 14 days after receipt of the confirmation email.

In case of late payment, the buyer is in default under legal conditions. The seller may withdraw from the contract and claim damages.

14. PayPal
Shipping occurs at least 3 working days after payment receipt. Delays caused by PayPal processing extend handling time. Buyer bears payment risks. Pickup is not possible with PayPal payment unless otherwise agreed.

15. VAT
EU buyers with valid VAT ID must pay VAT upfront; it is refunded upon submission of a correctly completed confirmation of receipt. Non-EU buyers pay net prices.

16. Pickup
Pickup is possible by appointment only.

17. Ratings
Feedback is generated automatically.

18. Right of withdrawal
Applies only to consumers. Business buyers have a 14-day return right only if technical defects exist or if explicitly stated.

19. Severability clause
If any provision is invalid, the rest remains valid. Legal provisions apply otherwise.

PRIVACY POLICY

Unless stated otherwise below, providing your personal data is neither legally nor contractually required, nor necessary for contract conclusion. You are not obliged to provide it. Non-provision has no consequences unless otherwise specified.

“Personal data” means any information relating to an identified or identifiable natural person.

Data collection and processing during orders

We collect and use your data only as necessary to process your order and inquiries. Providing data is required for contract conclusion; without it, no contract can be made.
